Please read these Terms of Service carefully before using this website. By accessing or using thesolanaclub.com (the "Site"), you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Who These Terms Apply To

These Terms of Service ("Terms") govern your access to and use of the website located at thesolanaclub.com, operated by Boutique Timeshare Management ("BTM," "we," "us," or "our") on behalf of Solana Beach Club & Exchange at Winners Circle Resort, 550 Via de la Valle, Solana Beach, CA 92075.

"You" refers to any individual who visits, browses, submits information through, or otherwise uses this Site.

2. Eligibility

This Site is intended for use by individuals who are at least 18 years of age. By using the Site, you represent that you are 18 or older. If you are under 18, you may not use this Site.

The vacation ownership interests described on this Site are available for purchase only by eligible buyers in accordance with applicable California real estate law and the terms of the DRE-approved Public Report. Accessing this Site does not constitute an application or qualification for ownership.

3. This Site Is Informational — Not a Binding Offer

This is important. Please read this section carefully.

The content on this Site — including all descriptions of vacation ownership interests, pricing, availability, unit configurations, amenities, exchange program details, and any other information about Solana Beach Club & Exchange — is provided for general informational and advertising purposes only.

Nothing on this Site constitutes:

A binding offer to sell or purchase a vacation ownership interest
A reservation or hold on any specific week or unit
A real estate purchase agreement or contract of any kind
Legal, financial, or investment advice

The actual terms, conditions, pricing, and legal disclosures governing any purchase of a vacation ownership interest at Winners Circle Resort are set forth exclusively in the California Department of Real Estate Public Report for this property and in a written purchase agreement signed by both parties. A copy of the Public Report is available upon request at no charge.

Pricing and availability information displayed on this Site is subject to change at any time without notice and does not represent a guaranteed offer. All ownership interests are subject to availability at the time of purchase.

4. Real Estate and Timeshare Disclosures

Vacation ownership interests at Winners Circle Resort are regulated by the California Department of Real Estate (DRE) under the Vacation Ownership and Time-Share Act of 2004 (California Business & Professions Code §§ 11210–11288).

This time-share plan is registered with the California Department of Real Estate as required by law. Registration does not constitute an endorsement of the time-share plan, and the California Department of Real Estate has not passed on the merits of the property being offered for sale.

As a general rule, promotional and marketing costs in a time-share offering constitute a major portion of the purchase price. Should you purchase a vacation ownership interest, you may find it difficult to resell your interest without the use of an extensive promotional and advertising campaign or sales organization.

No transaction involving the sale of a vacation ownership interest will be finalized without the provision of required disclosure documents and a written purchase agreement. California law provides purchasers of timeshare interests a seven (7) day right of rescission following execution of a purchase agreement. This right will be fully explained in your purchase documents.

5. Intellectual Property

All content on this Site — including text, copy, photographs, graphics, illustrations, logos, trademarks, trade names, and the SOLANA brand identity — is owned by or licensed to Boutique Timeshare Management and is protected under United States copyright, trademark, and other applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and view the content on this Site for your own personal, non-commercial use. This license does not permit you to:

Copy, reproduce, distribute, or republish any content from this Site without our prior written consent
Modify, adapt, translate, or create derivative works from Site content
Use any BTM or SOLANA trademarks, logos, or brand elements without prior written authorization
Remove or alter any copyright, trademark, or other proprietary notices
Use content from this Site for any commercial purpose without our written permission

Any unauthorized use of Site content may violate copyright, trademark, or other laws and may subject you to legal liability.

6. Permitted Use and Prohibited Conduct

You agree to use this Site only for lawful purposes and in a manner consistent with these Terms. You agree that you will not:

Use the Site in any way that violates applicable federal, state, or local law or regulation
Impersonate any person or entity, or misrepresent your identity or affiliation
Transmit any unsolicited or unauthorized advertising, promotional materials, or spam through the Site
Attempt to gain unauthorized access to any portion of the Site, its servers, or any connected systems
Use any automated tool, bot, scraper, spider, or similar technology to access, collect, or index content from the Site without our express written permission
Interfere with or disrupt the integrity or performance of the Site
Upload or transmit any material that contains viruses, malware, or other harmful code
Use the Site to collect contact information of other users for any unsolicited purpose
Engage in any conduct that restricts or inhibits anyone else's use or enjoyment of the Site

We reserve the right to terminate your access to the Site at any time, without notice, for any violation of these Terms or for any other reason at our sole discretion.

7. Accuracy of Information; No Warranties

We make reasonable efforts to ensure that the information on this Site is accurate and current. However, we do not warrant that the Site's content is complete, accurate, reliable, or up to date at any given time. Pricing, availability, unit specifications, amenity descriptions, exchange program terms, and other details are subject to change without notice.

THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, BTM expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

The Site will be uninterrupted, timely, secure, or error-free
Any errors will be corrected
The Site or its servers are free of viruses or other harmful components
The results obtained from use of the Site will be accurate or reliable

Some jurisdictions do not allow the exclusion of certain warranties. In such cases, the above exclusions may not apply to you in full.

8. Limitation of Liability

To the fullest extent permitted by California and federal law, BTM, its officers, directors, employees, agents, licensors, and service providers will not be liable for any damages of any kind arising from your use of, or inability to use, this Site or its content, including but not limited to:

Direct, indirect, incidental, consequential, or punitive damages
Loss of data, revenue, profits, or business opportunities
Damages arising from reliance on any information displayed on the Site
Damages resulting from unauthorized access to or alteration of your communications or data
Damages arising from third-party content or links accessed through the Site

This limitation applies regardless of the legal theory under which damages are sought and even if BTM has been advised of the possibility of such damages.

Nothing in these Terms limits BTM's liability for fraud, fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable law, including California consumer protection law.

9. Third-Party Links and External Content

This Site may contain links to third-party websites, including Interval International, local area businesses, and other resources. These links are provided for convenience only. BTM does not control, endorse, or assume responsibility for the content, privacy practices, or accuracy of any third-party site.

Accessing a third-party site through a link on this Site is at your own risk. We encourage you to review the terms and privacy policies of any external site you visit.

Section 9A: Third-Party Attraction References

References on this Site to nearby attractions, destinations, and points of interest — including but not limited to Disneyland^® Resort, SeaWorld^® San Diego, and LEGOLAND^® California — are provided for geographic and informational purposes only to assist visitors in understanding the location of Winners Circle Resort relative to popular Southern California destinations.

Boutique Timeshare Management and Solana Beach Club & Exchange are not affiliated with, associated with, authorized by, endorsed by, or in any way officially connected with The Walt Disney Company, SeaWorld Parks & Entertainment, Merlin Entertainments Group, or any other attraction, park, or destination referenced on this Site. All referenced attraction names, logos, and marks are the trademarks or registered trademarks of their respective owners. No commercial claim to those marks, and no suggestion of sponsorship or endorsement, is made or implied.

10. User-Submitted Content

If you submit any information through a form on this Site — including your name, contact information, questions, or inquiry details — you grant BTM permission to use that information to respond to your inquiry and to communicate with you about vacation ownership opportunities in accordance with our Privacy Policy.

You represent that any information you submit is accurate and that you have the right to submit it. You agree not to submit false, misleading, or unlawful information through the Site.

California law (Civil Code § 1670.8) protects your right to share honest reviews and feedback about businesses. Nothing in these Terms is intended to prevent you from making truthful statements about your experience with BTM or Solana Beach Club & Exchange.

11. Communications

By submitting a tour request or contact form on this Site and providing your phone number or email address, you consent to receive communications from BTM related to your inquiry, including email follow-up and SMS appointment reminders and notifications, as described in our Privacy Policy.

You may opt out of marketing email communications at any time by clicking the unsubscribe link in any email we send. You may opt out of SMS messages at any time by replying STOP to any message we send.

Opting out of marketing communications does not affect transactional messages related to a confirmed appointment or active inquiry.

12. Privacy

Your use of this Site is also governed by our Privacy Policy, available at thesolanaclub.com/privacy-policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and protect information about you.

13. Modifications to the Site and These Terms

BTM reserves the right to modify, suspend, or discontinue the Site — or any portion of it — at any time without notice or liability to you.

We may update these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page. Your continued use of the Site following any update constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

14. Governing Law

These Terms and any dispute arising from your use of this Site will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any legal action or proceeding relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in San Diego County, California. You consent to the jurisdiction of those courts.

15. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BTM regarding your use of this Site. They supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.

These Terms do not create any agency, partnership, joint venture, or employment relationship between you and BTM.
