Boutique Timeshare Management ("BTM," "we," "us," or "our") operates the website located at thesolanaclub.com (the "Site") on behalf of Solana Beach Club & Exchange at Winners Circle Resort. This Privacy Policy explains how we collect, use, and protect information about you when you visit our Site, submit an inquiry, schedule a property tour, or otherwise interact with us.

Please read this policy carefully. By using the Site, you acknowledge the practices described here. If you do not agree, please do not use the Site.


1. Who We Are

Boutique Timeshare Management is a California-based vacation ownership management company operating Solana Beach Club & Exchange at Winners Circle Resort, located at 550 Via de la Valle, Solana Beach, CA 92075.

Vacation ownership interests at Winners Circle Resort are sold by licensed real estate brokers and subject to regulation by the California Department of Real Estate (DRE) under the Vacation Ownership and Time-Share Act of 2004 (California Business & Professions Code §§ 11210–11288). A California DRE Public Report is available upon request.


2. Information We Collect

We collect two types of information: information you provide directly to us, and information collected automatically when you visit the Site.

Information You Provide Directly

When you submit a tour request, contact form, or other inquiry through the Site, we may collect:

  • Full name
  • Email address
  • Phone number

If you attend a property tour and engage further with our sales team in person, we may additionally collect information about your vacation preferences — such as preferred week or unit type — and store that information electronically in our customer relationship management system. You are not required to provide this information, and it is collected only during in-person interactions, not through the Site.

We do not collect payment card numbers, Social Security numbers, government-issued ID numbers, or other sensitive financial identifiers through this Site.

Information Collected Automatically

When you visit the Site, certain information is collected automatically through cookies and similar technologies, including:

  • Device and browser information (browser type, operating system, screen resolution)
  • IP address
  • Pages visited and time spent on the Site
  • Referring URLs (the page you came from before visiting the Site)
  • Interactions with site content

Email Communications To send you information about Solana Beach Club & Exchange, including ownership opportunities, property updates, and other content you have opted in to receive. See Section 6 for details on how to manage email preferences.

SMS Communications To send appointment reminders and notifications related to your scheduled tour or inquiry. See Section 7 for details on how to manage SMS preferences.

Analytics and Site Improvement To understand how visitors use the Site, identify technical issues, and improve the overall experience.

Advertising Measurement To measure the effectiveness of our advertising campaigns on platforms such as Meta (Facebook/Instagram) using aggregated and anonymized conversion data.

Legal Compliance To comply with applicable laws, regulations, and legal process, including obligations under California real estate and timeshare law.

We do not use your information to make automated decisions that produce legal or similarly significant effects on you.

Service Providers We work with trusted third-party vendors who support our operations. These vendors are permitted to use your information only to provide services on our behalf and are contractually required to protect it. Our current service providers include:

  • GoHighLevel — customer relationship management, tour booking, email communications, and SMS appointment notifications
  • Google LLC — website analytics (Google Analytics) and advertising measurement
  • Meta Platforms, Inc. — advertising measurement (Meta Pixel)
  • WordPress/Hosting Provider — website infrastructure

Legal Requirements We may disclose information when required by law, court order, or regulatory request, or when we believe disclosure is necessary to protect the rights, property, or safety of BTM, our clients, or the public.

Business Transfers In the event of a merger, acquisition, or sale of all or a portion of our business assets, your information may be transferred as part of that transaction. We will notify you of any such change via notice on this page.


5. Cookies and Tracking Technologies

What We Use

WordPress and Functional Cookies Our Site runs on WordPress and may set functional cookies necessary for basic site operation, such as session management and security features. These cookies do not collect personal information and cannot be used to track your activity across other websites.

6. Email Communications

If you submit a tour request or contact form, you may receive follow-up emails related to your inquiry and information about Solana Beach Club & Exchange.

To unsubscribe from marketing emails: Click the "Unsubscribe" link in the footer of any email we send, or contact us directly using the information in Section 13. We will process your request within 10 business days.

Transactional emails related to a confirmed appointment or inquiry (such as booking confirmations and reminders) may still be sent following an unsubscribe from marketing communications.


7. SMS Communications

By submitting a tour booking form and providing your mobile phone number, you consent to receive SMS text messages from Boutique Timeshare Management related to your scheduled appointment, including:

  • Booking confirmations
  • Appointment reminders
  • Follow-up notifications related to your inquiry

This is not a marketing SMS program. We do not send promotional offers or advertisements via SMS without separate express written consent.

To opt out: Reply STOP to any SMS message we send. You will be removed from all SMS communications immediately. Reply HELP for assistance.

Message and data rates may apply. Message frequency varies based on your scheduled appointment activity. Carriers are not liable for delayed or undelivered messages.

Opting out of SMS does not affect your email communications, and vice versa.


8. California Privacy Rights

This section applies to California residents and describes your rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA).

Your Rights

Right to Know You have the right to request that we disclose what personal information we have collected about you in the preceding 12 months, including the categories of information, the sources from which it was collected, the purposes for which it was used, and the third parties with whom it was shared.

Right to Delete You have the right to request deletion of personal information we have collected about you, subject to certain exceptions (such as information required to complete a transaction or comply with a legal obligation).

Right to Non-Discrimination We will not discriminate against you for exercising any of your rights under the CCPA. We will not deny you services, charge you different prices, or provide a different level of service because you exercised a privacy right.

Right to Limit Use of Sensitive Personal Information We do not collect sensitive personal information as defined by the CPRA (such as Social Security numbers, precise geolocation, financial account numbers, or health data) through this Site.

We will verify your identity before processing your request and respond within 45 days. If we need additional time, we will notify you and may take up to 90 days total to respond.

No method of data transmission or storage is 100% secure. We cannot guarantee absolute security, but we will notify affected individuals and regulators as required by law in the event of a data breach involving your personal information.


11. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this policy, including operational records, legal compliance, and dispute resolution. Contact and inquiry information for prospects who have not purchased a vacation ownership interest is retained for up to three years from last contact unless you request deletion earlier.

You may request deletion of your information at any time as described in Section 8.

This Site may contain links to third-party websites, including our exchange program partner (Interval International) and local area resources. This Privacy Policy does not apply to those third-party sites. We encourage you to review the privacy policies of any site you visit.
